Terms of Service

The rules for using ScamSweep’s website, apps, and scam-detection tools. They include important limits on liability and how disputes are handled.

1. Introduction and Agreement to Terms

Welcome to ScamSweep ("ScamSweep," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the ScamSweep website, mobile applications, APIs, scam-detection tools, educational content, and related services (collectively, the "Service"), operated by Synapse Forge LLC, a Nevada limited liability company.

By accessing, registering for, or using the Service, you ("you," "your," or "User") agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of another person (such as a family member) or an organization, you represent and warrant that you have the authority to bind that person or organization to these Terms, and "you" refers to both you and that person or organization.

2. Eligibility

You must be at least 18 years old to create an account or purchase a paid subscription. Users between 13 and 17 may use the free Service only with the consent and supervision of a parent or legal guardian. The Service is not directed to children under 13, and we do not knowingly collect information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at help@scamsweep.com and we will delete it promptly.

You may not use the Service if you are barred from doing so under the laws of the United States or any other applicable jurisdiction, or if you have previously been suspended or removed from the Service.

3. The most important thing you need to understand — NO GUARANTEE OF ACCURACY

Read this section carefully. It affects your legal rights.

ScamSweep provides educational information and automated analysis tools to help users identify potential scams, fraud, and suspicious communications. The Service uses a combination of rule-based analyzers, pattern matching, keyword detection, machine-learning models, and other automated systems to generate a probability score and classification for content you submit.

The Service is not infallible. It is an informational aid. It is not a substitute for your own judgment, professional advice, or verification through trusted channels.

You expressly acknowledge and agree that:

  1. The Service will sometimes incorrectly classify scams as safe (false negatives) and will sometimes incorrectly classify legitimate communications as scams (false positives).
  2. No automated detection system, including ScamSweep, can identify 100% of scams or guarantee that any specific message, link, phone number, or communication is safe or unsafe.
  3. Scammers continuously evolve their techniques. A communication the Service currently identifies as safe may later be revealed to be fraudulent, and vice versa.
  4. A verdict of "Likely Safe," "Suspicious," "Scam," or any similar classification is a probabilistic assessment only, not a guarantee or warranty.
  5. You are solely responsible for any decisions you make based on the Service's output, including but not limited to decisions to respond to, ignore, click, pay, transfer funds, provide information, report, or otherwise act on any communication.
  6. Before taking any significant action based on a Service verdict — particularly any action involving money, personal information, credentials, or contact with law enforcement — you should independently verify through official, trusted channels (e.g., by contacting your bank using the number on the back of your card, by contacting the relevant government agency directly, or by consulting a qualified professional).

The Service is not a substitute for legal advice, financial advice, law enforcement, a licensed investigator, a cybersecurity professional, or any other licensed professional service.

4. Automated Analysis and Artificial Intelligence

You understand and agree that verdicts, scores, explanations, and recommendations produced by the Service are generated wholly or partly by automated systems, including artificial-intelligence and machine-learning models, and may be produced without human review. These outputs:

  1. are statistical estimates that may be incomplete, inaccurate, or out of date;
  2. do not constitute a legal, financial, regulatory, or professional determination of any kind, and create no legal effect for or against you or any third party;
  3. may reflect limitations or biases inherent in automated systems and the data on which they are built; and
  4. must not be treated as the sole basis for any decision that has legal, financial, or safety significance.

Where you have a legal right to request human review of, or to contest, a decision made solely by automated means, you may exercise that right by contacting us at help@scamsweep.com.

5. No Special Relationship; Assumption of Risk

ScamSweep is a software tool and information service only. Your use of the Service does not create any fiduciary, advisory, agency, professional, guardianship, caregiver, custodial, or special relationship between you and ScamSweep, and ScamSweep owes you no duty of care beyond those expressly stated in these Terms and required by applicable law. We do not monitor your communications in real time, do not act on your behalf, and have no obligation to intervene in, prevent, or respond to any scam, fraud, transaction, or communication.

You knowingly and voluntarily assume all risk arising from scams, fraud, and deceptive communications, including the risk that the Service fails to detect a scam or misclassifies a legitimate communication. You are responsible for your own decisions and for verifying information through trusted, independent channels before acting.

6. Your Account

To access certain features, you must create an account. You agree to (a) provide accurate, current, and complete information; (b) maintain and promptly update your information; (c) keep your password confidential; and (d) notify us immediately at help@scamsweep.com of any unauthorized access or security breach. You are responsible for all activity occurring under your account, whether authorized by you or not, to the extent permitted by law.

We reserve the right to suspend or terminate accounts that we reasonably believe have been used to violate these Terms, abuse the Service, or engage in fraudulent or illegal activity.

7. Family Accounts and Use on Behalf of Others

The Service offers features that let one user (for example, an adult child) help protect another user (for example, an older parent) through linked or family accounts, alerts, and shared visibility into scan activity. If you set up, manage, or connect to another person's account, you represent and warrant that:

  1. you have that person's informed consent (or lawful authority) to do so;
  2. you will use family features only to help protect that person, and not to surveil, control, deceive, or harm them; and
  3. you are responsible for ensuring the connected person understands these Terms and the Privacy Policy to the extent they apply to them.

ScamSweep is not a substitute for guardianship, power of attorney, caregiving, or supervision, and assumes no responsibility for the relationship between connected users or for any action taken or not taken through family features. Either connected user may request that a connection be removed by contacting help@scamsweep.com.

8. Subscriptions, Payments, Auto-Renewal, and Cancellation

8.1 Paid Subscriptions

Certain features of the Service require a paid subscription ("Subscription"). Subscription fees, billing frequency, included features, and any usage limits are described at the point of purchase and may change from time to time as described below. Payments are processed by our third-party payment processor; by subscribing you also agree to that processor's terms.

8.2 Authorization and Automatic Renewal

Your Subscription will automatically renew at the end of each billing cycle (monthly or annually, as you selected) until you cancel. By starting a Subscription, you expressly authorize us and our payment processor to charge your payment method on file, on a recurring basis, the then-current price for your Subscription tier, plus applicable taxes, at the start of each renewal term, without further action by you. The billing interval and renewal price are disclosed to you before you complete your purchase, and your affirmative consent to these auto-renewal terms is obtained at that time.

8.3 Free Trials

If we offer a free trial, the length of the trial, whether a payment method is required, and the date and amount of the first charge are disclosed clearly at signup. Unless you cancel before the trial period ends, your Subscription will begin automatically and your payment method will be charged. A free trial may be limited to one per person or household and may not be combined with other offers.

8.4 How to Cancel — Easy Cancellation

You may cancel at any time, and cancellation is as easy as signing up. You can cancel through your account settings (Billing) in the same place you started the Subscription, or by emailing help@scamsweep.com. We will not require you to call, chat, or complete any step more burdensome than the steps used to subscribe. Cancellation takes effect at the end of your current billing period; you will keep access to paid features until then, and you will not be charged for any subsequent renewal term. If you purchased through a third-party app store (Apple App Store or Google Play), you may need to manage or cancel the Subscription through that store, per Section 15.

8.5 Renewal Reminders and Price-Change Notice

Where required by law, we will send you a reminder before an auto-renewal charge and before any material change to your Subscription. We will provide at least 30 days' advance notice of any price increase affecting an auto-renewing Subscription, and you will have the opportunity to cancel before the new price takes effect. If you do not cancel, the new price applies at your next renewal.

8.6 Refunds

Except where required by law, all fees are non-refundable, and we do not provide refunds or credits for partial billing periods or unused features. We may, in our sole discretion, offer refunds or credits in individual cases. Residents of California and of other jurisdictions with specific refund or cooling-off rights retain those rights as provided by applicable law. Purchases made through a third-party app store are subject to that store's refund policy.

8.7 Taxes

You are responsible for any applicable taxes associated with your Subscription.

8.8 Failed Payments

If a payment fails, we may retry the charge and may suspend your access to paid features until payment is successful. Repeated failed payments may result in cancellation of your Subscription.

9. Acceptable Use

You agree not to:

  1. Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  2. Submit content you do not have the right to submit, including content that infringes intellectual property rights or violates another person's privacy.
  3. Use the Service to train or benchmark competing automated systems, scrape our data, or reverse-engineer our detection logic.
  4. Submit content to the Service for the purpose of testing whether scam content evades our detection (i.e., using ScamSweep as a tool to refine fraud techniques). This is strictly prohibited and may result in reporting to law enforcement.
  5. Use automated systems (bots, scrapers, crawlers) to access the Service except as expressly permitted by our API terms.
  6. Attempt to circumvent rate limits, access controls, security measures, or account restrictions.
  7. Impersonate another person or entity, including ScamSweep staff.
  8. Interfere with, disrupt, or overload the Service or the networks connected to it.
  9. Use the Service to harass, threaten, or defame any person.
  10. Resell, sublicense, or commercially exploit the Service without our written permission.
  11. Submit malware, exploits, or other harmful code through the Service.

We reserve the right to investigate and take appropriate action, including account suspension or termination and referral to law enforcement, against anyone who violates these provisions.

10. User Submissions and Content

When you submit content to the Service for analysis — including text messages, emails, screenshots, phone numbers, URLs, or other communications ("User Content") — you represent that:

  1. You have the legal right to submit the content.
  2. You understand that the content may include personal information about third parties (such as a scammer's phone number or an email sender's identity), and submission is lawful in your jurisdiction.
  3. You are not submitting content that includes sensitive personal data of others (such as Social Security numbers, financial account numbers, or health information of third parties) except as necessary for a legitimate scam-analysis purpose.

License you grant us

You grant ScamSweep a non-exclusive, worldwide, royalty-free, sublicensable license to process, store, analyze, display back to you, and use your User Content for the purposes of: (i) providing the Service to you; (ii) improving our detection models and content (in aggregated, anonymized, or de-identified form); (iii) contributing anonymized signals to our threat-intelligence database; and (iv) complying with legal obligations.

We will not sell your User Content. We will not publish your User Content in a form that identifies you without your consent. See our Privacy Policy for full details on data handling.

Your content remains yours

You retain all ownership rights to your User Content. The license above is solely for operating the Service.

Content deletion

You may request deletion of your User Content by emailing help@scamsweep.com. We will delete it within 30 days, except to the extent we are required to retain it by law, or in de-identified aggregated form that cannot reasonably be re-associated with you.

11. Community Content and Reports

Some features may allow users to submit community scam reports or comment on others' reports. You are solely responsible for any community-facing submissions. We may moderate, remove, or edit community content at our sole discretion, and we do not endorse or guarantee the accuracy of any user-submitted community content.

You agree not to submit community content that is defamatory, harassing, false, infringing, or that identifies specific private individuals as scammers without verified evidence.

12. Third-Party Services and Links

The Service may display information from, or link to, third-party sources (such as FTC consumer alerts, news articles, reporting agencies, and other websites). These third-party sources are provided for your convenience and information. We do not control and are not responsible for the accuracy, content, or practices of any third-party source. Your use of any third-party site or service is governed by that third party's terms and policies.

13. Intellectual Property

The Service, including all software, content, designs, graphics, logos, trademarks, and compilations, is owned by ScamSweep or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Service for its intended purpose, subject to these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse-engineer or attempt to extract the source code or detection logic, except to the extent this restriction is prohibited by applicable law.

"ScamSweep" and any associated logos are our trademarks. You may not use them without our prior written consent.

14. Feedback

If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free license to use that Feedback for any purpose without obligation to you.

15. Mobile Applications and App Stores

We make the Service available as mobile applications through third-party platforms, including the Apple App Store and Google Play (each, an "App Store"). Your download and use of a mobile application is also subject to the applicable App Store's terms, and the following apply:

  1. These Terms are between you and ScamSweep only, not with any App Store. ScamSweep, not the App Store, is solely responsible for the Service and its content.
  2. The App Store has no obligation to provide any maintenance or support for the application. Address any such requests, and any product warranty claims to the extent not effectively disclaimed below, to ScamSweep at help@scamsweep.com.
  3. The App Store is not responsible for addressing any claim by you or a third party relating to the application, including product-liability, legal/regulatory, or intellectual-property claims.
  4. You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties.
  5. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS application and may enforce them against you. Subscriptions purchased through an App Store are billed by, managed through, and cancellable via that App Store under its rules, which may differ from Section 8.

16. Disclaimers — Please Read

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation.

Without limiting the foregoing, ScamSweep does not warrant that:

  1. the Service will accurately identify all scams or fraudulent communications;
  2. the Service will never incorrectly flag legitimate communications as scams;
  3. any specific communication is or is not a scam based on a Service verdict;
  4. the Service will be uninterrupted, timely, secure, or error-free;
  5. any information obtained through the Service will be accurate or reliable; or
  6. any errors in the Service will be corrected.

The Service does not provide legal, financial, medical, or professional advice. It does not replace professional judgment, law enforcement, or licensed professionals.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, the excluded warranties are limited to the minimum extent required by applicable law.

17. Limitation of Liability

To the maximum extent permitted by law: (a) in no event shall ScamSweep, its officers, directors, employees, agents, affiliates, licensors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, emotional distress, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages. (b) In no event shall ScamSweep be liable for any financial loss you sustain as a result of a scam, fraud, or deceptive communication, including cases where the Service failed to identify the communication as fraudulent or incorrectly identified it as legitimate. (c) Our total cumulative liability to you for all claims arising out of or relating to the Service or these Terms is limited to the greater of (i) the total amount you paid ScamSweep in the twelve (12) months immediately preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars ($100). (d) These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if a limited remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability is limited to the minimum extent required by applicable law.

18. Indemnification

You agree to indemnify, defend, and hold harmless ScamSweep and its officers, directors, employees, agents, affiliates, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right; (d) any User Content you submit; and (e) any decision you make or action you take (or fail to take) based on the Service's output.

19. Dispute Resolution — Arbitration Agreement and Class Action Waiver

Please read this section carefully. It affects your legal rights.

19.1 Informal resolution first

Before initiating any formal proceeding, you agree to contact us at help@scamsweep.com and attempt in good faith to resolve the dispute informally for at least 60 days.

19.2 Binding arbitration

If the dispute is not resolved informally, you and ScamSweep agree to resolve any dispute arising out of or relating to these Terms or the Service through final and binding individual arbitration, rather than in court, except as provided below. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Clark County, Nevadaor by videoconference at your option, and will be conducted in English. The arbitrator's decision will be final and binding.

19.3 Exceptions to arbitration

Either party may bring an individual claim in small-claims court if it qualifies. Either party may also seek injunctive relief in court for intellectual property or unauthorized access claims.

19.4 Class action waiver

You and ScamSweep agree that any dispute shall be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

19.5 Right to opt out

You may opt out of this arbitration agreement by emailing help@scamsweep.comwithin 30 days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and including your name and account email. Opting out will not affect any other part of these Terms.

19.6 If arbitration is unenforceable

If the arbitration agreement is found unenforceable, the remainder of these Terms will remain in effect, and any dispute will be resolved in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.

20. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law principles, except where preempted by federal law (including the Federal Arbitration Act).

21. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may terminate your account at any time by canceling your Subscription and requesting account deletion at help@scamsweep.com.

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, dispute resolution, and intellectual property) will survive.

22. Electronic Communications and Notices

By using the Service, you consent to receive communications from us electronically — including by email, by messages within the Service, and by notices posted on the Service — and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

We will send legal notices to the email address associated with your account; it is your responsibility to keep it current. You may send legal notices to us at help@scamsweep.com or by mail to the address in Section 30. Service-related and transactional messages are part of the Service and cannot be opted out of while you maintain an account; you may opt out of marketing emails at any time.

23. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have an account) or by a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and may cancel your Subscription.

24. Privacy

Your use of the Service is also governed by our Privacy Policy. Please read it to understand how we collect, use, and protect your information.

25. Copyright / DMCA

If you believe content on the Service infringes your copyright, please send a notice to our Designated Copyright Agent at help@scamsweep.com including: (a) your signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act.

26. Accessibility

We are committed to making the Service accessible. If you experience difficulty accessing any part of the Service, please contact us at help@scamsweep.com so we can assist you and address the issue.

27. International Users

The Service is operated from the United States. If you use the Service from outside the United States, you are responsible for compliance with local laws. By using the Service, you consent to the transfer of your information to the United States.

Note for EU/UK/EEA residents: If GDPR or UK GDPR applies to you, additional rights and obligations apply as described in our Privacy Policy. Nothing in these Terms limits your mandatory consumer rights under applicable local law.

28. State-Specific Consumer Notices

California residents.Under California Civil Code § 1789.3, California users are entitled to the following notice: you may contact us regarding the Service at help@scamsweep.com or by mail at the address in Section 30. To file a complaint or obtain further information, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. California subscribers also retain the cancellation and auto-renewal rights described in Section 8 and under the California Automatic Renewal Law.

Nothing in these Terms limits any non-waivable right or remedy available to you under the consumer-protection laws of your state of residence.

29. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and any other policies referenced, constitute the entire agreement between you and ScamSweep.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.

No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

No third-party beneficiaries. Except for the App Store beneficiary rights in Section 15 and the released parties named in these Terms, there are no third-party beneficiaries to these Terms.

Force majeure. We are not liable for any delay or failure in performance caused by circumstances beyond our reasonable control.

Headings. Section headings are for convenience only and do not affect interpretation.
